1. Who we are

These terms apply to services provided by FittonMillett Ltd, a company registered in England and Wales under company number 15226381. Registered office: Unit C Piccadilly Business Centre, Aldow Enterprise Park, Blackett Street, Manchester, M12 6AE. Contact: hello@fittonmillett.com.

2. What these terms cover

These terms govern your use of the FittonMillett website (fittonmillett.com) and any services you purchase from FittonMillett Ltd, including:

• The Recruitment Health Check and Blueprint (£197 digital product)
• The Recruitment Diagnostic (£997 consulting engagement)
• The 90-Day Recruitment Reset (£1,500 mentoring programme)
• ATS and Automations build and support (from £400 per month)
• Any additional consulting, training or advisory services

By purchasing a service or using this website, you agree to these terms.

3. Services and delivery

FittonMillett Ltd provides consultancy, systems design, mentoring and digital product services to care sector organisations globally. Specific deliverables, timelines and working arrangements are confirmed in writing prior to engagement commencing.

Digital products (including the Health Check and Blueprint) are delivered via third-party platforms. Access is provided upon successful payment. Delivery of consulting and mentoring services is subject to agreed schedules and may be rescheduled by either party with reasonable notice.

4. Payment

Prices are as stated on this website at the time of purchase. All prices are exclusive of VAT unless otherwise stated. Payment for digital products is processed via Stripe. Payment for consulting engagements is invoiced and due within 14 days of invoice date unless otherwise agreed in writing.

Late payment may result in suspension of services. FittonMillett Ltd reserves the right to charge statutory interest on overdue amounts under the Late Payment of Commercial Debts (Interest) Act 1998.

5. Cancellations and refunds

Digital products (Health Check and Blueprint): due to the nature of instant digital access, refunds are not available once access has been granted, except where required by applicable consumer protection law.

Consulting and mentoring engagements: cancellation within 48 hours of a scheduled session is subject to the full session fee. Cancellation of a full programme (90-Day Reset or Diagnostic) after work has commenced is subject to a charge for work completed to date, with any balance refunded.

The guarantee on the Recruitment Diagnostic ("find £5k or you don't pay") is applied at the conclusion of the audit. If no recoverable cost of £5,000 or more is identified and evidenced in the written report, no fee is due and any payment received is refunded in full.

The six-month recoup guarantee on ATS builds is assessed at the six-month anniversary of go-live, based on evidenced agency spend reduction. Any refund due is processed within 14 days of that assessment.

6. Intellectual property

All frameworks, methodologies, templates, written content, and digital materials created by FittonMillett Ltd (including the C.E.R.T framework, the Health Check, and the Blueprint workbook) remain the intellectual property of FittonMillett Ltd. You are granted a personal, non-transferable licence to use purchased materials for your own internal business purposes. You may not reproduce, resell, or distribute them without prior written permission.

Where FMC builds systems or materials inside your own accounts (Airtable, Make.com and similar), those assets belong to you from the moment of creation. FMC retains collaborator access solely for the duration of the agreed support period.

7. Confidentiality

Both parties agree to keep confidential any non-public information shared during an engagement. FittonMillett Ltd will not share client business data, figures or identifying information with any third party without consent, except where required by law.

8. Limitation of liability

FittonMillett Ltd provides advice, frameworks and systems based on experience and available information. We cannot guarantee specific commercial outcomes. Our liability for any claim arising from services provided is limited to the total fees paid for the specific engagement to which the claim relates.

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud or any other liability that cannot be excluded by law.

9. Data protection

FittonMillett Ltd processes personal data in accordance with UK GDPR and the Data Protection Act 2018. Our Privacy Policy sets out how we collect, use and protect your data. By purchasing a service or contacting us, you confirm you have read our Privacy Policy.

10. Governing law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to these terms

FittonMillett Ltd may update these terms from time to time. The current version is always published at fittonmillett.com/terms. Continued use of our services after an update constitutes acceptance of the revised terms.
