Terms of use and terms of sale

This page has two parts. Part A covers your use of this website and its free tools. Part B covers the purchase of the Recruitment Health Check and Blueprint, our online digital product. The shared terms at the end apply to both.

If you are buying the Recruitment Health Check and Blueprint, you are agreeing to the whole of this page when you tick the box at checkout. Please read Part B before you pay.

Who we are

This website, fittonmillett.com, is owned and operated by FittonMillett Ltd, trading as FittonMillett Consultants (FMC). We are a private limited company registered in England and Wales, company number 15226381. Registered office: Unit C Piccadilly Business Centre, Aldow Enterprise Park, Blackett Street, Manchester M12 6AE.

We are not VAT registered. No VAT is charged or shown on any price.

Part A: using this website

A1. These terms

These terms govern your use of this website and the free tools and resources on it. By using the site you agree to them. If you do not agree, do not use the site.

A2. Using the site

You may use the site for lawful purposes only. You must not:

• Use the site in any way that breaks the law or infringes anyone's rights
• Copy, scrape, harvest or reproduce any content, tools or code from the site except as these terms allow
• Attempt to gain unauthorised access to the site, its hosting, or any system connected to it
• Introduce viruses, malicious code or anything designed to interfere with the site
• Use any automated means to access the site without our written permission
• Submit false, misleading or malicious information through any form or tool
• Use the site to send unsolicited communications or to impersonate anyone

We may suspend or block access to the site for anyone who breaches these terms.

A3. Free tools and resources

The site includes free tools and downloadable resources, which may include a recruitment cost calculator, guides for care managers, and previews or samples of our paid products.

These are provided free of charge for general information only. In particular:

• Any figure produced by a calculator or tool is an estimate based on the information you enter and on general assumptions. It is not a quote, a forecast or financial advice
• Guides and resources reflect our experience and opinion at the time they were written. They are not legal, HR, employment law, financial or regulatory advice, and they do not tell you what CQC, Ofsted or any other regulator requires of you
• You are responsible for checking anything on this site against your own circumstances before acting on it

Where a form asks for your details in exchange for a resource, our Privacy policy explains what we do with those details.

A4. Paid products and services

We sell products and services through this site and through direct agreement with clients:

• Recruitment Health Check and Blueprint: bought online and governed by Part B of this page
• Masterclass tickets: bought online and governed by the ticket terms for that masterclass, linked from its page and its checkout
• Recruitment Diagnostic, 90-Day Reset and applicant tracking system builds: governed by the terms and conditions or written agreement issued to you for that service

If you have signed a written agreement with us, that agreement governs the service it covers. These website terms do not add to or change it. If anything on this site conflicts with a signed agreement, the signed agreement applies.

Prices shown on the site are correct at the time of publication and may change. The price that applies is the price shown when you buy or the price in your written agreement, whichever is relevant.

A5. Third party services and links

The site links to and uses third party services, including Stripe for payments, Fantastical for booking calls, and social media platforms. These have their own terms and privacy notices. We are not responsible for their content, availability or how they handle your data once you leave our site or interact with their service.

Links to other websites are provided for convenience. We do not endorse them and are not responsible for what they contain.

A6. Availability

We aim to keep the site available but do not promise that it will be uninterrupted, error free or free of viruses. We may change, suspend or remove any part of the site at any time without notice. We do not promise that content is complete or up to date.

A7. Liability for the website and free content

Subject to the shared terms below, and to the extent permitted by law:

• We provide the site, its free tools and its free resources as they are, without any warranty as to accuracy, completeness or fitness for any purpose
• We are not liable for any loss or damage arising from your use of, or reliance on, the site, its free tools or its free resources

Liability for the Recruitment Health Check and Blueprint is dealt with in Part B. Liability for other paid services is dealt with in the terms that apply to each of them.

Part B: Recruitment Health Check and Blueprint terms of sale

B1. What these terms cover

Part B applies to the purchase and use of the Recruitment Health Check and Blueprint (the Blueprint), a digital product sold through this site. If Part A and Part B conflict on anything to do with the Blueprint, Part B applies.

Part B is written for care providers and other organisations buying the Blueprint for use in their business. If you are buying as a consumer, section B12 applies to you as well.

Part B also applies to the Blueprint when it is included in a £197 masterclass ticket. Our masterclass ticket terms call it the Care Recruitment Blueprint. It is the same product.

B2. What you are buying

The Blueprint is an online self-assessment and planning tool. It consists of:

• A Recruitment Health Check of 54 questions across 9 stages of the recruitment and retention process
• A score out of 180 based on your answers
• A costed Recruitment Blueprint, generated from your answers, setting out a prioritised plan for your organisation

The Blueprint is built on our C.E.R.T. framework (Create, Expand, Retain, Train). It is a self-guided product. It does not include a call, a review, or any consultancy time with us. Those are separate services with their own terms.

B3. Price and payment

The price is £197. This is a one-off payment. There is no subscription and no recurring charge.

Payment is taken by card through Stripe, our payment processor. We do not see or store your card details. Stripe's own terms and privacy notice apply to the payment.

Your purchase is complete when Stripe confirms payment. Stripe will send you a payment receipt by email.

B4. Access and delivery

Payment is taken by Stripe. After payment you are shown a confirmation page and we send an access code to the email address you used at checkout. The code is in the format FMC-XXXX-XXXX and is normally sent within a few minutes. If it has not arrived within an hour, check your spam folder and then email hello@fittonmillett.com from the address you paid with.

Delivery is complete when the access code is sent. There is no physical product and nothing is posted to you.

To use the tool, enter your code at fittonmillett.com/health-check or fittonmillett.com/blueprint. Your code does not expire and works on any device. Once entered, the browser you used stays signed in for 7 days, after which you enter the code again.

The code is for your organisation only. Do not share it with anyone outside your organisation. We may cancel a code that is shared, resold or misused.

B5. Saving your answers and your plan

The tool works in two stages and they save differently:

• Health Check answers are held only while the page is open. If you reload the page, close the tab or lose your connection before you submit, your answers are lost and you start the Health Check again. Set aside time to complete all 54 questions in one sitting
• Blueprint progress is saved in your own web browser on the device you use, not on our servers. If you clear your browser data, use a private or incognito window, or switch to a different device or browser, your progress will not be there and you start the Blueprint again

Your access code always gets you back in, so you can restart either stage at any time. We cannot recover lost answers or progress for you. Save or print your completed Blueprint as soon as it is generated.

Having to restart for any of these reasons does not entitle you to a refund.

B6. No refunds

The Blueprint is digital content. Delivery is complete when your access code is sent, and no refund is available after that point, for any reason, including if you change your mind, do not use the code, do not complete the Health Check, lose your answers or progress, or decide the plan is not what you expected.

If you buy as a consumer, see section B12.

B7. What the Blueprint is and is not

The Blueprint gives you a structured view of your recruitment and retention process and a plan based on the answers you give. Its usefulness depends entirely on the accuracy and honesty of those answers.

The Blueprint is not:

• Legal, HR, employment law, financial or regulatory advice
• A statement of what CQC, Ofsted or any other regulator requires of you
• A guarantee of any result. We make no promise about applicant numbers, time to hire, agency spend, cost savings, staff retention or any other outcome

The costs shown in the Blueprint are estimates produced from your answers and from general assumptions. They are there to help you prioritise. They are not quotes, forecasts or financial projections and should not be relied on as such.

You remain responsible for your own recruitment decisions, your compliance with employment law, safer recruitment requirements and your regulator's standards, and for checking anything in the Blueprint against your own circumstances before acting on it.

B8. Your responsibilities

You agree to:

• Answer the Health Check honestly and to the best of your knowledge
• Use the Blueprint for one organisation only. If you run more than one registered service or location, one purchase covers one organisation. If you want to run it separately for several services, contact us
• Not use the Blueprint to provide services to third parties. It is not licensed for use by recruitment agencies, consultants or software providers in delivering services to their own clients

B9. Licence

Your purchase gives you a personal, non-transferable licence to use the Blueprint within your own organisation for as long as it remains available. It does not give you any ownership of the material.

You may print or save your completed Blueprint and share it with people inside your organisation, including your board, owners or senior team. You may not copy, reproduce, publish, resell, adapt or reverse engineer any part of the tool, or remove any FMC branding from it.

The answers you enter are yours. The plan generated from them is our copyright, licensed to you as above.

B10. Availability and changes to the tool

We aim to keep the Blueprint available online, but we do not promise uninterrupted access. The tool may be unavailable for maintenance, updates, or reasons outside our control such as hosting or internet faults.

We may update the questions, scoring, plan content or design at any time to improve the product. We may also withdraw the Blueprint from sale or retire the tool. If we retire the tool, we will give reasonable notice on our website where we can. This is why we recommend you save or print your completed Blueprint.

B11. Liability for the Blueprint

Subject to the shared terms below, our total liability to you for any claim arising from the Blueprint, whether in contract, tort, negligence, misrepresentation or otherwise, is limited to the price you paid for it.

We are not liable for any loss arising from your reliance on the Blueprint, the costs it estimates or the plan it produces, from your inability to access the tool, from loss of progress or data stored in your browser, or from the acts or omissions of Stripe or any other third party service.

B12. If you are buying as a consumer

The Blueprint is designed for care providers and is normally bought by a business. If you are an individual buying it for purposes wholly or mainly outside your trade, business or profession, you are a consumer and the following applies in addition to Part B.

You have a legal right to cancel a purchase of digital content within 14 days. However, by ticking the box at checkout, whether you buy the Blueprint on its own or as part of a masterclass ticket, you expressly request that we send your access code immediately after payment, and you acknowledge that you lose your right to cancel once the code has been sent.

Nothing in these terms affects your legal rights as a consumer, including your rights under the Consumer Rights Act 2015 for digital content to be of satisfactory quality, fit for purpose and as described. Where any term here would take away a right the law gives you as a consumer, that term does not apply to you.

B13. Your data

We are the data controller for the personal data involved in your purchase and your use of the tool. What we receive:

• From Stripe when you pay: your name, email address and payment record. We never see or hold your card details
• When we issue your access code: the code and the email address it was sent to, held in our records so we can support you and check the code is valid
• When you submit the Health Check: your name, email address, organisation, whether you chose to receive our newsletter, your score for each of the nine stages and your total score

We do not receive your 54 individual answers. We do not receive the Blueprint plan generated for you. Blueprint progress stays in your browser as described in section B5.

We use the scores to understand how care providers are performing across the nine stages and to improve the product. If you opted in to the newsletter you can unsubscribe at any time.

Shared terms

S1. Intellectual property

All content on this site belongs to FittonMillett Ltd or to our licensors. This includes the text, design, graphics, logos, tools, calculators, downloadable documents, code, and the C.E.R.T. framework (Create, Expand, Retain, Train) and the questions, scoring model, 9 stage structure and plan format of the Recruitment Health Check and Blueprint.

You may view the site and print or download single copies of pages and free resources for your own use within your organisation. You may not:

• Reproduce, republish, distribute or sell any content or tool from the site
• Use the C.E.R.T. framework, the Health Check structure or any of our methods to provide services to third parties
• Remove or alter any copyright notice or FMC branding

Our name, logo and trading style are our property. You may not use them without our written permission.

S2. Liability that cannot be limited

Nothing on this page limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be limited or excluded by law.

Subject to that, we are not liable for any indirect or consequential loss, or for loss of profit, business, revenue, anticipated savings, contracts, goodwill or data.

S3. Privacy and cookies

Our Privacy policy at fittonmillett.com/privacy explains what personal data we collect and what we do with it. Our Cookie policy at fittonmillett.com/cookies explains the cookies the site uses and how to change your choice.

S4. General

If any part of these terms is found to be invalid or unenforceable, the rest continues to apply. If we do not enforce a term on one occasion, we may still enforce it later.

For the Blueprint, Part B and the shared terms are the whole agreement between you and us. They replace anything said or written before you bought it.

S5. Changes to these terms

We may update these terms from time to time. The current version is always published at this address with the date it was last updated. For the website, continued use after a change means you accept the updated terms. For the Blueprint, the version in force on the date you buy is the one that applies.

S6. Governing law

These terms are governed by the law of England and Wales. Any dispute will be dealt with by the courts of England and Wales. If you are a consumer living in Scotland or Northern Ireland you may also bring proceedings in your local courts.
